Legal status & protection of cultural venues
What this indicator asks
Are music and club venues in São Paulo recognised in law as cultural places, and does that recognition protect them?
27.0/ 100 · São Paulo
We looked at three issues: whether night culture is legal where it happens, whether venues hold a legal status as culture, and whether that status protects them. Promises and studies score lower than laws in force.
The city has a law that protects the cultural use of a place, and it has worked. In 2025 the heritage council protected the Augusta cinemas and their use as cinemas, after a court stopped their demolition.
The one music venue that applied, Bar Ó do Borogodó, a samba and choro bar in Pinheiros, was refused by seven votes to one in February 2026. The campaign has become a city-wide movement, “Não Quero Sair do Mapa” (“I don’t want to leave the map”).
Under the city’s noise rules, a repeat violation leads to the venue’s closure, with no hearing before the closure. No legal category for music venues or clubs exists.
